Affordable Housing Nonprofit in Philadelphia Seeking Tax Counsel

Receiving nonprofit tax exemption could save our nonprofit nearly $100k annually in expenses.

Posted December 10, 2024

Background & Context

The Korean Community Development Services Center (KCDSC), located in Philadelphia, was founded in late 1983. Initially, KCDSC served new Asian immigrants arriving in the U.S., but now it serves any resident living in the 19120 zip code of Philadelphia in three areas: (1) immigration; (2) affordable housing; and (3) childcare for low-income families.

We currently pay a significant amount of money in property taxes annually, and it has recently come to our attention (through our auditor) that we may be exempt from having to pay those taxes.

Immediate Problem

I am seeking legal advice to determine whether or not our nonprofit is exempt from paying annual property taxes. Our properties are generally used for charitable purposes.

Work & Deliverables

Our nonprofit is seeking an attorney who specializes in real estate and tax law. We believe we are eligible to receive a tax exemption for the properties that we own and are used for affordable housing and other charitable purposes. We are seeking an attorney who can guide us through that process.

Project Plan

Preparation Phase

  • Schedule a background call with volunteer coordinator
  • Sign volunteer agreement and return to nonprofit

Collaboration Phase

  • Review requirements for real estate tax exemption
  • Determine whether our nonprofit is eligible for tax exemption
  • Assist our nonprofit with filing of tax exemption application

Korean Community Development Services Center

The Korean Community Development Services Center (KCDSC) was founded in Philadelphia in late 1983. Initially, KCDSC served new Asian immigrants arriving in the U.S., but now we serve anyone who lives in the Olney neighborhood of Philadelphia in three service areas: (1) immigration; (2) affordable housing; and (3) childcare for low-income families. 100% of the children we serve are low-income and Black or Latinx. The vast majority of clients that we serve in our immigration and housing programs are also low-income and minoritized.
