Posted August 1, 2024
Background & Context
On March 27, 2023, a massive fire broke out in a Mexican immigration detention center in Ciudad Juarez, killing 40 migrants and severely injuring and disabling 27 others. Mexico's top immigration official and other authorities and guards have been criminally charged for their refusal to open the cell and failure to keep detainees safe. One of the family members/caretakers of a survivor, an indigenous woman from Guatemala, is living in Ohio with her young daughter, having entered the U.S. on humanitarian parole. They are facing deportation and need representation to seek termination of their removal proceedings and assist them in affirmatively applying for asylum, or otherwise represent them in their defensive asylum proceedings.
Immediate Problem
Filing of I-589 asylum application by one-year deadline on October 10, 2024.
Work & Deliverables
Either represent family of two in defensive asylum proceedings in Cleveland Immigration Court, or seek prosecutorial discretion (to dismiss or administratively close removal proceedings) and represent the family in affirmative asylum proceedings before USCIS.
Preparation Phase
- Schedule background call with IMUMI attorney
- Schedule initial call with client (Spanish-speaking only)
Collaboration Phase
- Prepare request for prosecutorial discretion to terminate or admin. close removal proceedings
- Represent family in either affirmative or defensive asylum proceedings
